Child Custody Disputes | Family Law Reno

June 30, 2023 //  by Anderson Keuscher

Dealing with child custody disputes is never an easy feat. The complexities of emotions, legal processes, and parental rights can be daunting, to say the least. At Anderson Keuscher, as your trusted family attorney in Reno, we’ve noticed a common concern echoed by many parents – the fear of being alienated from their children due to a disagreement with the other parent.

Recently, a compelling discussion on the Alice 96.5 Morning Show highlighted these concerns. Jessica Anderson, a prominent family attorney from our firm, shared her insights during the “Love Court” segment.

What We Learned from the Show

The listener’s question revolved around a father who hadn’t seen his kids for five months. The children’s mother, his ex, dictated the terms of visitation, often restricting the father from taking his kids out and enjoying time with them.

Jessica pointed out that unless there are substance abuse, physical abuse, or mental health issues involved, there’s no basis for restricting a parent’s access to their children. Moreover, in Nevada, parents are presumed to be joint physical custodians until a court order states otherwise. This means both parents have equal access to their children.

However, it’s crucial to approach the situation delicately. If the children haven’t spent considerable time with a parent, a “ramp-up” schedule could be introduced. This might start with daytime visits, progressing to overnight stays, eventually moving towards an equitable 50-50 custody.

What This Means For You

If you’re a parent facing a similar issue, remember:

  1. Your rights matter. Unless there are specific reasons for restricting access, both parents are entitled to equal time with their children.
  2. Legal intervention might be necessary. If you feel your rights are being violated, consider filing a petition to establish custody and support. Reach out to us and let our expert family attorney team in Reno guide you.
  3. Communication is crucial. While seeking legal recourse, it’s beneficial to maintain open lines of communication with the other parent. The ultimate goal is ensuring the well-being and happiness of your children.

Final Thoughts

We deeply respect the dedication and love parents have for their children. At Anderson Keuscher, we’re here to ensure that your rights and your children’s interests are protected. If you have questions or need guidance, don’t hesitate to contact us or call directly at 775-406-0305.
